If you are considering (a) granting a lease of business tenancy to a company or (b) taking a lease we suggest that you consider the following matters whilst negotiating the terms of the lease: (i) The Length of lease (the term of the tenancy) (ii) Break clauses: this is where the landlord or tenant can bring the lease to an end prior to the end of the term with appropriate notice (iii) Whether the lease it is outside or inside the Landlord & Tenant Act: ie will the tenant be able to renew the tenancy at the end of the term. (iv) The rent to be charged initially and rent reviews (v) Responsibilities for maintenance and repairing of the property (vi) Repair (including Dilapidations): ie the work that is required to put the property into a proper state of repair during or at the end of the term.
